Terms and Conditions

The Client wishes to obtain and “New Life” language school represented by Hanna Nadtochii, an individual entrepreneur, under jurisdiction of Ukraine number of state registration № 2 556 000 0000 038860 on 13.03.2006, taxpayer number 2799718720 (further in the document “the School”), wishes to provide, tutoring services on Ukrainian language according to the following terms:

 

1. Obligations of the School

* The School is obliged to provide the Client with online Ukrainian lessons by Skype or Zoom in the amount that has been paid for.

* In case when the School failed to provide the Client with the lessons, it is obliged to give the Client 100%  refund.

* The School shall keep confidential all information about the Client. See our Privacy Policy

2. The tutor

The tutor is one of the teachers who works at “New Life” school on the basis of work contract.

 

3. Payment

The first trial lesson is free and lasts for 20 — 30 minutes.

After the first trial lesson The Client pays for the package of lessons in advance and continues their studies.

 

Currency conversion

By making the payment on the site by Visa or Master Card the Client agrees on the conversion of the currency of his bank card to Ukrainian currency according to the rate established by the bank of the School.

 

The payment is processed via LiqPay system. LiqPay reliability is confirmed by PCI DSS, Verified by Visa and Mastercard SecureCode certificates.

Making payments in LiqPay consists of 3 stages:

1. When making a payment, the user enters the payment details of the card: card number, expiration date, CVV code.

2. An operation is confirmed by entering a one-time password from SMS, which is sent to the user's mobile phone.

3. Also, an operation is confirmed using 3-D Secure. This is a technology for entering an additional security password for payment.

 

4. Fees and schedule for the online Ukrainian lessons

Fees shall be calculated at a rate of 20 US dollars per 60 minutes of tutoring. The Client can prepay a package of lessons and get a discount according to our pricing plans.

 

Fees may be adjusted from time to time. The fees of the lessons which have already been paid for cannot be changed.

Tutoring schedule is mutually agreed upon by the Tutor and the Client.

 

5. Refund policy

In case when the client can’t take prepaid lessons and informed the Tutor about it at least 24 hours before the start, the payment can be frozen for the term up to 6 months. Refund is not given.

 

6. Late arrival

Fees are calculated according to the times stipulated in the schedule and no adjustment shall be made for time lost because of late arrival by the Client or technical failure from the Client’s side.

Any lost time because of the late arrival of The Tutor or technical failure from the side of the Tutor shall be compensated for by extending a lesson by mutual agreement and by such amount of time that was lost.

 

7. Individual lesson cancellation

In case when the Client did not come to the lesson and did not inform the Tutor about his absence minimum 12 hours before the lesson, the payment is charged and the lesson can not be rescheduled.

In case when the Client informed the teacher about his absence 12 hours or more before the lesson, the individual lesson can be rescheduled to another day.

8. Obligations of the Client

The Client agrees that assignments, exercises or homework form an integral part of tutoring and undertakes to complete such work timeously.

 

9. Termination

This tutoring contract may be terminated by either party at any time by giving the other party (3) three days prior written notice.

If the contract is terminated by the Client the refund is not given.

 

10. Controlling Law and Arbitration

This agreement shall be interpreted and enforced in accordance with the laws of Ukraine.  The parties agree that no action by one party against the other may be brought in any court, in any jurisdiction, except according to the terms of this paragraph. No termination or expiration of this agreement shall affect the right to arbitrate disputes.

 

11. Force Majeure

Neither party will be liable to the other by reason of any failure in performance of this Agreement if the failure arises out of the fires, strikes, delays in transportation, riots or war, or any causes beyond the reasonable control of that party. These circumstances do only apply, if the situation is drastically unusual.

 

 

12. Miscellaneous

This contract is bi-lingual, English — Ukrainian. Shall any inconsistencies or disputes arise, English text takes precedence over Ukrainian.
